TERMS AND CONDITIONS for SHOPPERS

1. ACCEPTANCE OF TERMS:
This page (together with the documents referred to on it) tells you the Terms & Conditions of ijapkogirl, the terms applicable to the sale of goods or services through the Site. We may update these Terms & Conditions from time to time and will notify such changes to you by uploading them on the Site. You should review the Terms & Conditions periodically for changes.

By using the Site you agree to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions then please refrain from using the Site.

ACCESSING OUR SITE
Access to the Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on the Site without notice. We will not be liable if for any reason the Site is unavailable at any time or for any period. From time to time, we may restrict access to some parts of the Site, or the entire Site, to users who have registered with us. Any personal data and other information provided by you is processed by us in accordance with our Privacy Policy. By providing any such personal data or other information you agree to the terms of our Privacy Policy.

2. INTELLECTUAL PROPERTY RIGHTS
We are the owner or the licensee of all intellectual property rights in the Site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. You must not use any part of the materials on our site for commercial purposes without obtaining a license to do so from us or our licensors. If you breach these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made. We respect the intellectual property rights of others and we ask our Member Partners to do the same. 3. ELIGIBILITY TO PURCHASE
The purchase of merchandise through ijapkogirl is strictly limited to parties who can lawfully enter into and form contracts on the Site in accordance with English law. In order to make purchases, you must email iheartlesha@gmail.com Customers must provide their real name, phone number, e-mail address and other requested information as indicated. Furthermore, when ordering items, you will be required to provide payment details and you represent and warrant that the payment details you provide on ordering are both valid and correct and you confirm that you are the person referred to in the Billing information provided.

The Site is available only to individuals and others who meet the ijapkogirl terms of eligibility, who have been issued a valid credit card by a bank acceptable to ijapkogirl, whose applications are acceptable to ijapkogirl and who have authorized ijapkogirl to process a charge or charges on their credit card in the amount of the total purchase price for the merchandise which they purchase. Purchases made on the site are for the personal or gift use of the buyer only and are not to be used for re-sale, commercial purposes or any other commercial benefit. ijapkogirl reserves the right to restrict multiple quantities of an item being shipped to any one customer or postal address. Moreover, by making an offer to purchase merchandise, you expressly authorize us to perform credit checks and, where ijapkogirl feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties from time to time, including but not limited to your credit-card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit card, to obtain an initial credit card authorization and to authorize individual purchase transactions.

4. ORDERS
All orders are subject to acceptance and availability. ijapkogirl offers products for sale that are in stock and available for dispatch from our distribution centers. Occasionally, however, we may be waiting for shipments from our Member Partners.

5. ACCEPTANCE OF YOUR ORDER
Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order.

Unless you cancel your order, acceptance of your order and completion of the contract between you and ijapkogirl will be perfected when payment is received by us and we dispatch the goods to you.

We reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set-out above.

Furthermore, we may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the Site whether or not that merchandise has been sold; removing, screening or editing any materials or content on the Site; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

6. PAYMENT
Payment can be made by bank-to-bank deposits, money transfers, G-Cash, Smart Money, Visa, Visa Electron, MasterCard, Megalink/Bancnet debit cards, and PAYPAL. Payment will be debited and cleared from your account upon receipt of your order by ijapkogirl. You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorization by the card issuer.

If the issuer of your payment card refuses to authorize payment to ijapkogirl, we will not be liable for any delay or non-delivery. We take all reasonable care to make our Site as secure as we can make it. All credit card transactions on this site are processed using Datacash, a secure online payment gateway that encrypts your card details in a secure host environment. We will also give you the opportunity to securely store your credit card details on our systems. These details will be fully encrypted and only used to process card transactions. To help ensure that your shopping experience is safe, simple and secure ijapkogirl uses Secure Socket Layer (SSL) technology. Furthermore, we will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the Site.

7. INSURANCE AND DELIVERY
ijapkogirl insures each purchase during the time it is in transit until it is delivered to you. We will only ship within the Philippines. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by ijapkogirl and transfer of responsibility in the same way.

8. NO COMMERCIAL USE
This Site is for your personal, non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any Content, software, products, or services contained within this Site. You may not use this Site, or any of its Content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own Site.

Please also note that products offered for sale by ijapkogirl are directed solely at Philippine residents. ijapkogirl and its Member Partners make no representation that any products sold through this website are appropriate or available for use outside of the Philippines. You must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.

Using this site you abide with our RETURNS and EXCHANGE POLICIES for further details, including practical guidance.

10. LINKS
You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. Our Site must not be framed on any other website, nor may you create a link to any part of our Site other than the home page. We reserve the right to withdraw linking permission without notice.

The Site provides links to other websites for your information. We have no control over such sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

11. VIRUSES, HACKING, AND OTHER OFFENSES
You must not misuse our site by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of-service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any material posted on it, or on any website linked to it.

12. WAIVER
If we fail at any time to insist upon strict performance of any of your obligations under these Terms & Conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under them, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.

A waiver by us of any default shall not constitute a waiver of any subsequent default. No waiver by us of any of these Terms & Conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

13. SEVERABILITY
If any of these Terms & Conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

14. ENTIRE AGREEMENT
These Terms & Conditions and any document expressly referred to in them represent the entire agreement between us and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.

15. FORCE MAJEUR
Where ijapkogirl is prevented from or delayed in the carrying on of its business due to circumstances beyond its reasonable control including, without limitation, acts of God, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labor disputes (whether or not relating to the Member Partner’s workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials the date of delivery shall be postponed for the period that the circumstances continue.

16. YOUR ACTIVITY
If we determine, in our sole discretion, that you engaged in prohibited activities, or otherwise violated our terms and conditions, we may deny you access to this Site on a temporary or permanent basis and any decision to do so is final.

17. GENERAL
While ijapkogirl will use reasonable endeavors to verify the accuracy of any information it places on the Site, it makes no warranties, whether express or implied in relation to its accuracy. This Site is provided on an "as is" and "as available" basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to this Site, or any transaction that may be conducted on or through this Site including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.

We make no warranty that this Site will meet your requirements or will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that this Site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy, reliability of the materials. We will not be responsible or liable to you for any loss of Content or material uploaded or transmitted through this Site.

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the products available through this Site including but not limited to, implied warranties of satisfactory quality and fitness for a particular purpose. Nothing in these terms and conditions shall limit your rights. You acknowledge that we cannot guarantee and therefore shall not be in any way responsible for the security or privacy of this Site and any information provided to or taken from this Site by you.

You agree that, except for death and personal injury arising from our negligence, We will not be liable in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent misrepresentations) or otherwise out of or in connection with this contract, for any economic losses (including without limitation, loss of revenues, profits, contracts, business or anticipated savings), any loss of goodwill or reputation, or any special or indirect or consequential losses in any case whether or not such losses were incurred by that party arising out of or in connection with the provisions of any matter under the terms and conditions.

18. INDEMNIFICATION
At our request, you agree fully to defend, indemnify and hold harmless ijapkogirl and iHeartLesha Corporation immediately on demand, its officers, directors, agents, affiliates, licensors, and suppliers, from and against all liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of the terms and conditions by you or any other liabilities arising out of your use of this Site, or the use by any other persons accessing this Site using your Internet account. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you hereunder.

19. OUR RELATIONSHIP
You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you and ijapkogirl or with iHeartLesha Corporation as a result of the terms and conditions or your use of this Site. You agree that you may not and will not hold yourself out as a representative, agent, or employee of ijapkogirl and iHeartLesha Corporation, and we shall not be liable for any representation, act, or omission on your part.

20. ENTIRE AGREEMENT
The Terms and conditions (as amended from time to time) constitutes the entire agreement between you and ijapkogirl regarding your use of this Site, and supersedes any other agreement or understanding, arrangements, undertaking or proposal, written or oral, between you and ijapkogirl in relation to such matters. In the event any other rules, code of conduct, or other matter posted on this Site conflicts with the terms and conditions, the terms and conditions of this site shall govern. No oral explanation or oral information given by any party shall alter the interpretation of the terms and conditions. You confirm that, in agreeing to accept the terms and conditions, you have not relied on any representation save insofar as the same has expressly been made a representation in the terms and conditions and you agree that you shall have no remedy in respect of any misrepresentation which has not become a term of the terms and conditions save that your agreement contained in this Clause shall not apply in respect of any fraudulent misrepresentation whether or not such has become a term of the terms and conditions.

21. GOVERNING LAW
The terms and conditions together with all our policies and procedures will be governed by and construed in accordance with the laws of the Philippines and you irrevocably submit to the exclusive jurisdiction of the courts of the Philippines.
